The Insurance
Law Department of Benjamin, Yocum, & Heather, which is chaired by principal
Timothy P. Heather, represents insurance companies and their insureds throughout
the state and federal courts of Ohio, Kentucky, and Indiana. The firm is actively
engaged in all areas of tort and insurance defense law, including motor vehicle
accidents, product liability, property damage claims, and declaratory judgment
actions.The MIST (minor impact soft tissue) and Special Investigations Unit/ Fraud Group of the firm's Insurance Law Department, which is led by principal, Anthony J. Iaciofano, vigorously defends against claims made against insurers and their insureds which involve excessive and unnecessary medical treatment and/or fraudulent appearing bodily injury and property damage claims. Much of the work done in these areas relates to pre-suit activities such as obtaining examinations under oath from claimants; working with medical, arson cause and origin, and biomechanical experts; and a close coordination of efforts with the particular claims adjuster assigned to a claim. The Insurance Law Department of Benjamin, Yocum & Heather has a diverse base of insurance company clients which write multi-line insurance coverages, including motor vehicle, homeowners, commercial, surety, and life insurance coverages. The Insurance Law Department is often asked to interpret the provisions of existing insurance policies and coverages under existing policies. These requests give rise to complex issues, in which the Insurance Law Department is experienced, such as applicability of exclusions, questions of permissive use, and coverage and policy stacking. Research is a vital part of litigation. In order to represent the client to the fullest extent possible, the attorneys of Benjamin, Yocum & Heather frequently consult with a complement of experts for the defense of claims. The firm's attorneys utilize engineers, accident-reconstruction experts, arson and fire related experts, bad faith experts, physicians and other medical professionals, economists, and vocational consultants to build a solid base for the client's defense. The firm uses the Westlaw computer legal research system so as to ensure the most accurate and current legal research possible.
