Business and Construction Law Department of Benjamin, Yocum, & Heather
has extensive experience in business and construction law matters. The practice
spans a broad range of business matters with emphasis in commercial and industrial
construction projects. The firm has been involved in numerous types of projects,
including shopping centers, malls, schools and universities, airports, utility
power plants, high rise buildings, hospitals, highways and roads, parking
garages, professional sports stadia and office and warehouse facilities. The firm's construction clients include subcontractors, material suppliers, general contractors, owners, architects and engineers. The firm's other business clients include manufacturing, advertising, computer service, professional service and many other types of businesses. The attorneys of the Benjamin, Yocum, & Heather Business and Construction Law Department are active in various organizations, including, Allied Construction Industries, the American Subcontractors Association, and the Construction Specifications Institute. Firm attorneys are regular contributors to publications with legal articles pertaining to general business, employment relations and topics unique to the construction industry. Thomas R. Yocum is chairman of the Benjamin, Yocum, & Heather Business and Construction Law Department. Tom joined the predecessor firm of Benjamin, Yocum, & Heather upon his graduation from the University of Cincinnati Law School in 1979. He is one of the founding principals of Benjamin, Yocum, & Heather and has been an integral part of the impressive growth that Benjamin, Yocum, & Heather has experienced over the years. Lisa M. Bitter, member of the firm, contributes valuable experience to the Benjamin, Yocum, & Heather Business and Construction Law Department in representing clients in OSHA matters. Lisa's experience in administrative proceedings before OSHA enable her to advise clients on both how to avoid OSHA problems and how to deal with citations that are issued. Lisa also provides services for the firm's business clients regarding estate planning, and business entity formation. Richard O. Hamilton, Jr. is an associate of the firm, concentrating in construction claims, arbitrations, litigation and employment relations. Mr. Hamilton brings to the Business and Construction Law Department valuable industry experience in design and construction management involving residential and commercial projects and land acquisition services. This experience adds to the firm's resources in the areas of drafting contracts covering the full range of construction oriented services, from basic subcontract agreements, architectural and design service contracts, design-build contracts, to land sale agreements. Mr. Hamilton provides employment services including drafting employee handbooks, developing programs that address sexual harassment and discrimination, employee disciplinary issues, and other employment-related issues, including defending EEOC/OCRC charges and discrimination lawsuits. The Business and Construction Law Department offers a broad range of services spanning from routine collections to complex legal issues. The firm has successfully handled cases challenging the constitutionality of MBE/WBE programs. For example, as a result of litigation filed by Benjamin, Yocum, & Heather, Hamilton County, Ohio dropped MBE/WBE preferences on the $400,000,000.00 Paul Brown/Cincinnati Bengals Stadium project. The firm also handles mechanic's liens and bond claims, bid protests, and creditors' rights in bankruptcy. With attorneys admitted to practice in Ohio, Kentucky, Indiana and Florida, the Benjamin, Yocum, & Heather Business and Construction Law Department provides a "regional presence." The firm is very active in arbitrations, including those before the American Arbitration Association. Tom Yocum is a member of the American Arbitration Association panel of arbitrators for the construction industry.
